Terms of Service

The agreement governing your access to The BMT Blueprint.

1. Parties & Acceptance

These Terms of Service ('Terms') constitute a legally binding agreement between you ('Member', 'you', 'your') and BMT Trading Group Pty Ltd (ACN 700 967 513) trading as The BMT Blueprint ('BMT Blueprint', 'we', 'us', 'our'), a company registered under the laws of New South Wales, Australia.

BMT Trading Group Pty Ltd owns The BMT Blueprint and all associated products and platforms. Dev Dahiya operates those properties and delivers coaching and mentorship on behalf of the company. Your contract is with BMT Trading Group Pty Ltd.

By purchasing, accessing, or using any product or service offered by The BMT Blueprint, including the Foundation and Continuation programs and any associated platform or tool, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must not access or use any BMT Blueprint product or service.

These Terms apply to all members, employees, contractors, agents, affiliates, and any other person acting on behalf of or in association with The BMT Blueprint ('Associated Persons').

2. Eligibility

To access any BMT Blueprint product or service, you must:

3. Nature of Service — Education Only

IMPORTANT: BMT Trading Group Pty Ltd does not hold an Australian Financial Services Licence and is not an authorised representative of any AFS licensee. Nothing BMT provides is offered as, or should be treated as, a financial service within the meaning of section 766A of the Corporations Act 2001 (Cth), or as financial product advice within the meaning of section 766B.

3.1 What the service is

BMT provides education and training in trading methodology. That means instruction in generic, transferable concepts: market structure, risk management arithmetic, execution process, record keeping and journalling, and trader psychology. Teaching is delivered using historical charts, completed price action, and illustrative examples.

BMT does not, and will not:

3.3 No personal advice

The Member acknowledges that BMT has not considered their objectives, financial situation, or needs, and that nothing provided constitutes personal advice within the meaning of section 766B(3) of the Corporations Act 2001 (Cth).

Where a Member discusses their own trading in a 1:1 session, that discussion is confined to the Member's adherence to their own written trading plan and their own process and discipline. It is not an assessment of whether any trade, instrument, or product is suitable for that Member, and must not be relied on as one.

3.4 Independent decisions

Every trading decision a Member makes is their own. The Member warrants that they do not and will not rely on BMT in making any decision about a financial product, and that where they require advice they will obtain it from the holder of an Australian Financial Services Licence.

3.5 Charting and analysis tools

BMT provides educational charting tools, including indicators that mark structural features of price such as areas of interest and changes of character. These tools:

Where a tool supports alerts, those alerts are configured and enabled by the Member, on instruments and timeframes of the Member's own choosing. BMT does not broadcast instrument-specific alerts, publish watchlists, or operate any scanning or signal feed.

A marked area is a description of chart structure. It is not an indication that a trade should be taken, and it is not a recommendation to act. The Member remains solely responsible for deciding whether to do anything at all.

3.6 No performance representation

BMT makes no representation, guarantee, or implication as to any trading outcome, income, funded account, evaluation pass, or payout. Past results, whether BMT's own or any Member's, are not indicative of future results. Trading derivatives and leveraged products carries a substantial risk of loss, and a Member may lose more than their initial capital.

BMT bears no responsibility for any financial loss, trading loss, or consequential loss arising from a Member's own trading decisions.

4. Membership Tiers & Payment

The BMT Blueprint offers two membership tiers, both delivered as 1:1 private mentorship. There is no community-only tier, group mentorship tier, or self-study tier. Pricing is subject to change with reasonable notice, and the price applicable to a Member is the one recorded in the agreement they signed at enrolment.

All payments are processed securely through Whop and its integrated payment processors. The BMT Blueprint does not store payment card information. Failed payments will result in automatic suspension of access until payment is rectified.

5. Cancellation & Access Termination

Members may cancel their membership at any time subject to the minimum commitment periods outlined in Section 4. Cancellation takes effect at the end of the current billing cycle. No pro-rata refunds are provided for unused days within a billing period.

Upon cancellation or termination, all access to BMT Blueprint content, Discord channels, and associated resources will be revoked immediately or at the end of the billing cycle, as applicable.

The BMT Blueprint reserves the right to terminate any membership immediately and without refund in the event of:

6. Intellectual Property

All content, materials, systems, methodologies, videos, recordings, written content, trade plans, and educational frameworks provided through The BMT Blueprint are the exclusive intellectual property of BMT Trading Group Pty Ltd (ACN 700 967 513) trading as The BMT Blueprint.

Members are granted a personal, non-transferable, non-exclusive licence to access and use content solely for their own private educational purposes. This licence does not permit:

Breach of this section may result in immediate termination and legal action for intellectual property infringement.

7. Your Rights Under the Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified. Where any provision of these Terms or of any other BMT agreement conflicts with that, the Australian Consumer Law prevails.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, services must be provided with due care and skill, be reasonably fit for any purpose we have described, and be supplied within a reasonable time.

If we fail to meet one of those guarantees, you are entitled to the remedies the Australian Consumer Law provides:

Where these Terms, the Participant Agreement, or any other BMT document states that fees are non-refundable, that a deposit is non-refundable, or that no refund will be issued under any circumstances, that statement operates only to the extent the law permits. It does not remove and is not intended to remove any refund right you have under the Australian Consumer Law.

8. Limitation of Liability

To the maximum extent permitted by Australian law, BMT Trading Group Pty Ltd, The BMT Blueprint, Dev Dahiya, and all Associated Persons expressly disclaim all liability for:

Where liability cannot be excluded by law, and to the extent the Australian Consumer Law permits liability to be limited, our total liability to any member is limited, at our option, to resupplying the services or paying the cost of having them resupplied, or otherwise to the total amount that member has paid to BMT Trading Group Pty Ltd under the agreement giving rise to the claim. Nothing in this section limits any liability that cannot lawfully be limited.

9. Indemnification

You agree to indemnify, defend, and hold harmless BMT Trading Group Pty Ltd, Dev Dahiya, The BMT Blueprint, and all Associated Persons from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

10. Dispute Resolution

In the event of a dispute arising out of or in connection with these Terms, the parties agree to attempt resolution through good faith negotiation within 14 days of written notice of the dispute.

If the dispute cannot be resolved through negotiation, the parties agree to attempt mediation through the Australian Disputes Centre or a mutually agreed mediator before commencing legal proceedings.

These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales.

11. Modifications

We may modify these Terms. Where a change materially affects your rights or obligations, we will give you at least 14 days' written notice before it takes effect, by email or through the Discord server, and publish the updated Terms here.

If you do not accept a material change, you may terminate your agreement by written notice before the change takes effect, and receive a pro-rata refund of any fees paid for services not yet delivered. Continued use of any BMT service after a change takes effect constitutes acceptance of it.

12. Entire Agreement

These Terms, together with the Privacy Policy and the Participant Agreement you signed at enrolment, constitute the entire agreement between you and BMT Trading Group Pty Ltd.

Where there is any inconsistency between them, the following order of precedence applies:

Nothing in this section overrides Section 7. Your rights under the Australian Consumer Law prevail over all of the above.

These Terms supersede prior representations or understandings about the matters they cover, but do not supersede the Participant Agreement.
